Peter Jennings Died of lung Cancer yesterday.  I am shocked and surprised, because I had not heard that he was even sick much less dying.  I can't remember a single national news event that has taken place during my lifetime that he did not give some sort of comentary or perscetive.  But life is this way, here today gone tommorrow.  Nothing last forever, not even the moon and stars.

For any of my fans, readers, or friends who take the time to read my blog first I wanna say thanks.  I have noticed that there have been more and more visitors lately, and  I  am aware that I am somewhat liberAL and open minded about most things. So I hope that I am able to propegate some of my viewpoints here for what I think is the better good of all.

Thank you for contacting me regarding the USA PATRIOT (United

and Strengthening America by Providing Appropriate Tools

Required to Intercept and Obstruct Terrorism) Act. I sincerely

appreciate you taking the time to contact me, and I care

greatly about your views on this important matter of homeland

security.

History of the USA PATRIOT Act and its Current Status

In 2001, the USA PATRIOT Act passed the House of

Representatives by a vote of 337-79 and the Senate by a vote

of 96-1.  On October 26, 2001, President Bush signed the Act

into law.

As you may be aware, several sections of Title II of the USA

PATRIOT Act are scheduled to expire on December 31, 2005

unless extended. These sections relate to foreign intelligence

and law enforcement surveillance authority1. It is important

that Congress reapprove the USA PATRIOT Act to ensure the

ability of intelligence and law enforcement agencies to

protect our homeland and national interests against domestic

and foreign threats.

President Bush addressed the importance of renewing the USA

PATRIOT Act during his 2004 State of the Union address: "Key

provisions of the PATRIOT Act are set to expire next year. The

terrorist threat will not expire on that schedule. Our law

enforcement needs this vital legislation to protect our

citizens. You need to renew the PATRIOT Act2." While great

strides have been accomplished in fighting the war against

terror, we must continue to pursue those terrorists such as

Osama bin Laden that have yet to be brought to justice.
Giving Law Enforcement the Tools they need to Fight Terrorism

The USA PATRIOT Act provides several important judicial and

law enforcement tools to combat the war on terror. First, the

USA PATRIOT Act classifies a wide variety of terrorist

activities as federal crimes, including terrorist attacks on

mass transportation facilities, biological weapons offenses,

harboring terrorists, affording terrorists material support,

misconduct associated with money laundering, conducting the

affairs of an enterprise which affects interstate or foreign

commerce through the patterned commission of terrorist

offenses, and fraudulent charitable solicitation. The encoding

of these acts as federal law helps to ensure that there are no

major gaping holes in the ability of prosecutors to

incarcerate those who seek to commit terrorist actions.  While

many of these actions were previously designated as crimes on

the state level, the USA PATRIOT Act elevates these crimes to

the federal level and increases the penalties for such

actions.

Second, the USA PATRIOT Act seeks to codify search and seizure

procedures that have already been upheld by case law. The

authority to conduct searches without notification does not

give law enforcement carte blanche inspection authority,

because these searches can only be used in a very narrow set

of circumstances. The same judge who issues a search warrant

must also approve law enforcement's request to search without

notification. This serves as an effective check on civil

liberty encroachments without just cause. Moreover, once the

individual(s) has been searched, law enforcement is only

permitted a reasonable period of time to withhold the

information about the search3. These procedures are nothing

new¾the Department of Justice already uses similar tools for

tracking down illegal drug and mafia activities. The USA

PATRIOT Act extends this authority to terrorist activity,

enabling law enforcement to catch suspected terrorists without

alerting them and/or their associates to the possibility of

capture.

Third, the USA PATRIOT Act aims to streamline judicial

red-tape.   The Act makes it easier for law enforcement

agencies to obtain the necessary permissions from a single

source rather than wasting time by contacting multiple

jurisdictions for approval of the same search. For example,

Section 220 of the Act "allows for nationwide search warrants

for e-mail instead of requiring separate search warrants for

each jurisdiction in which the e-mail may be located, such as

at the ISP's location rather than where a crime was

committed4." In this example, and in many other provisions,

the USA PATRIOT Act seeks to allow law enforcement to spend

more of their time doing their job instead of obtaining

multiple warrants for the same alleged offense or requesting

to conduct a lawful search.

Congressional Oversight and Protecting Civil Liberties

Congress has made it a priority to maintain direct oversight

of the USA PATRIOT Act. Since the legislation became law, the

House and Senate have conducted numerous hearings regarding

the USA PATRIOT Act, including 13 hearings this legislative

session. Moreover, as directed by the statute, the Attorney

General must report to the Congress every six months on the

status of certain provisions of the Act5.

Despite all of the protests and concerns that civil liberties

are being violated by the implementation of the USA PATRIOT

Act, opponents of the legislation are short on examples of law

enforcement abuses. As William J. Bennett states, "The truth:

Senator Joe Biden recently said attacks on the Patriot Act are

'ill-informed and overblown.' Senator Dianne Feinstein

recently said, 'I have never had a single abuse of the Patriot

Act reported to me.' And when Senator Feinstein asked the ACLU

for examples of civil liberty abuses, she reported, "They had

none.6" Critics of the USA PATRIOT Act regularly complain

about 'big-brother' coming in to abuse the civil liberties of

ordinary Americans; however, since the legislation was signed

into law by President Bush, this has not been the case.

Furthermore, in drafting the USA PATRIOT Act, Congress

attempted to provide the right balance between respecting a

citizen's right to privacy and giving law enforcement the

ability to investigate those suspected of attempting terrorist

activities. Opponents of the USA PATRIOT Act protest the

abilities of law enforcement to conduct certain searches

without the prior notification of the suspected person(s). But

as Heather Mac Donald writes in The Washington Post, "The

Patriot Act naysayers don't tell you that there is nothing new

about this power at all: Judges have long allowed the

government to delay notice of a search if notifying the target

would risk witness intimidation, destruction of evidence or

flight from prosecution. The Patriot Act merely codifies

existing case law into one national standard7."

Future Prospects for the USA PATRIOT Act

I have confidence in the ability of the Judiciary Committees,

under the direction of my colleague Chairman James F.

Sensenbrenner (R-Wisconsin), to conduct fair and substantial

hearings and make adequate recommendations to Congress on

improving the USA PATRIOT Act.

Thankfully, the United States has been able to avert another

major terrorist attack since 9-11. However, many terrorists

are determined to destroy America and our way of life. We must

remain vigilant and determined to defeat terror organizations

before they have the ability to attack.

Apperently, we don't agree with this act.  So I guess he won't be getting my vote next go around!

Probation.  It is supposed to be something our criminal justice system has provided to offenders to be a 'second chance' for people who are not career criminals from going to prison.  When a court sentences someone to 'Commuinity Supervision' they are ordered by the court to fullfill said requirements and constraints that the individual must adhere to in order to meet the terms laid out by the court for the person who is placed into this system. Usually this will include things like probation fee's, community service, various courses and classes that one must participate in that are relavent to the crime committed.  For example, DUI probationers will often take alcohol and drug awareness classes, or Assault probationers will be ordered to take anger management classes.  While on community supervision the probationer's case will be assigned to a case worker, or 'probation officer' who will monitor and track the progress of the individual during the course of the probation sentence.  Probation should be a good thing, and people who are not 'career criminals' should not find it particularly difficult to live up to the terms of their sentence if they do what they are told.  In theory, this is how the system (as I understand it) is supposed to work.  But does it really work this way?  In Texas, many people who are sentenced to probation for moderate to serious offenses don't make it.  Infact, the legislator passed a law that allowed probationers who complete all of the said terms of a probation sentence early (with only the time variable remaining in question) to petition the court to release them early from thier sentence after 1/2 of the total time sentenced had been reached.  Therefor someone who takes all thier classes, pays their fines, and does all of the required community service with a 4 year sentence could ask to be let off the sentence after only 2.  This law was passed, many believe, because the rate of successful completion of probatated sentences was surprissingly low.  Less then half of all those sentenced to probation actually completed it.  So the logic was that perhaps the system was being to stringent, to hard for people to live up to the heavy burden that probation can exact upon the lives of people who are trying to remain free from imprisonment and the experience of going to prison.  But when you look at the demographic statics of those who are on probation, and you pay attention particullarly to the education and economic backgrounds of those on community superivision quickly you see that the majority of those in the system are mostly from the lower class and are less educated.  So, probation was started to be a second chance for good people, who have temporarily gone down the wrong path, and with a little time and good behavior people can get a second chance.  But there is a psychology at work here, something deeper in the minds of those caught in this system that is almost as dambing as actually going to jail.

The American Dollar has been for years the worlds currency, buying everything from Baby Food To Bullets anywhere anytime.  Often times it has served as the MAIN currency exchanged in countries who's monetary system lacked the public confidence or real value.  This has bought America many benifits, and I suspect has fed the flames of Anit-Capitalist Anti-American Ideals in places unfriendly to America.  Conversly, the benifit of having another nation dependant upon our currency in terms of influence and control are duanting  and largely overlooked here in the States.
